Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and El Paso Investigations, PLLC (“El Paso Investigations,” “we,” “us,” or “our”) governing your access to and use of our website and services (the “Services”). By using the Services, submitting a request, or applying for or holding a membership, you agree to these Terms. If you do not agree, do not use the Services. Please also review our Privacy Policy.
1. Definitions
- Client — a person or organization seeking investigative services through the Services.
- Member Agency (or “Member”) — an independent investigation agency that holds a membership and may receive referrals.
- Listed Individual — an individual investigator listed under a Member Agency (for example, in cascading-license states) rather than as a Member.
- Referral / Lead — a Client request that we route to, or that is claimed by, a Member Agency.
2. What El Paso Investigations is
El Paso Investigations is a private investigation referral broker. We connect Clients with independent, licensed Member Agencies. We do not provide investigative services, we are not a party to any engagement between a Client and a Member Agency, and we do not direct, supervise, or guarantee the work of any Member Agency. Using the Services does not create any partnership, joint venture, employment, or agency relationship between you and El Paso Investigations. We are not a consumer reporting agency and the Services are not a consumer report.
3. Eligibility and accounts
You must be at least 18 and able to form a binding contract. You agree to provide accurate, current, and complete information, to keep your account credentials secure, and to be responsible for all activity under your account. Notify us promptly of any unauthorized use.
4. Client terms
- Requests. When you request an investigator, you authorize us to share the request details with the Member Agency matched to or claiming your Referral so that it may contact you. You will then deal directly with that agency, which is solely responsible for any services it provides.
- Lawful and permissible purpose. You represent that you are seeking services for a lawful purpose and that you have a permissible purpose to obtain any information you request. You may not use the Services to stalk, harass, intimidate, or harm any person, or to obtain or use information in violation of law, including, where applicable, the Fair Credit Reporting Act (FCRA), the Driver’s Privacy Protection Act (DPPA), the Gramm-Leach-Bliley Act (GLBA), and state surveillance and anti-stalking laws.
- No guarantee. We do not guarantee that a Member Agency will be available for your request or your location.
5. Membership terms (investigators and agencies)
- Eligibility and licensing. Membership is available to investigation agencies that are properly licensed where the law requires it. We may verify licensing and credentials, and we may decline, suspend, or terminate any membership at our discretion.
- Cascading-license states. In states where an individually licensed investigator must operate under a licensed company (for example, Texas, where an individual must be employed by and linked to a licensed company), an individual may not be a Member directly but may be added as a Listed Individual under a Member Agency, subject to verification.
- States served and reciprocity. Your public visibility is based on the states where you are eligible. Where permitted, visibility may extend to additional states through recognized reciprocity. You are responsible for confirming your own authority to work in any state.
- Static published fees. Members publish static fees for their services through the Services and do not provide on-the-spot quotes through the platform. You set, and are solely responsible for, your own fees and the accuracy of your listing.
- Maintaining eligibility. You must keep your information and licensing accurate and current. You will not receive Referrals, and your listing may be suspended, if your license is invalid, revoked, suspended, or expired, or if applicable cascading-license requirements are not satisfied.
- Listed Individuals. Individuals you add are listed publicly only after staff verification. You are responsible for the accuracy of information you provide about them and for their conduct in connection with the Services.
- Your responsibilities. Member Agencies are independent businesses and contract directly with Clients. You are solely responsible for your services, deliverables, client agreements, insurance, and compliance with all applicable laws (including licensing, FCRA, DPPA, GLBA, and surveillance laws).
- No guarantee of leads. We do not guarantee any number, quality, or exclusivity of Referrals, and we may route a request to more than one agency.
6. Referrals and leads
We may publish anonymized lead teasers and route or release Client request details to eligible Member Agencies. Client contact details are released to the licensed Member Agency that is matched to or claims a Referral. Referrals are provided without exclusivity and without warranty. Any engagement, scope, fees, and deliverables are agreed solely between the Client and the agency.
7. Fees and payment
- Membership fee. Membership is $49 per year, billed annually through our payment processor, Stripe.
- Authorization and auto-renewal. You authorize us and Stripe to charge your payment method for the membership fee and applicable taxes. Unless you cancel, membership renews automatically each year at the then-current rate, using the payment method on file.
- Cancellation. You may cancel at any time. Cancellation stops future renewals and takes effect at the end of the current paid term; your listing and Referral eligibility end when the paid term ends.
- Failed payments. If a payment fails, we may retry, and we may suspend or terminate Referral eligibility and your listing until payment is resolved.
- Refunds. Except where required by law, membership fees are non-refundable, including for partial periods.
- Taxes and price changes. You are responsible for applicable taxes. We may change membership pricing on a going-forward basis with notice.
8. Acceptable use
You agree not to: provide false or misleading information; use the Services for any unlawful, harassing, or harmful purpose; infringe others’ rights; scrape, harvest, or misuse data; interfere with or disrupt the Services; attempt unauthorized access; or misrepresent your licensing or affiliation. We may remove content and suspend or terminate access for violations.
9. Intellectual property; your content; feedback
The Services, including their content, software, and branding, are owned by El Paso Investigations or its licensors and are protected by law. You may not copy, modify, or use them except as permitted. You retain ownership of content you submit (such as your listing) and grant us a non-exclusive, worldwide, royalty-free license to host, display, and use it to operate and promote the Services. If you send feedback, we may use it without obligation to you.
10. Third-party services
The Services rely on third parties, including Stripe for payments. Your use of those services is subject to their terms and policies, and we are not responsible for them.
11. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY MEMBER AGENCY’S SERVICES WILL MEET YOUR EXPECTATIONS. WE ARE NOT RESPONSIBLE FOR THE ACTS, OMISSIONS, LICENSING, OR WORK OF ANY MEMBER AGENCY OR CLIENT.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, EL PASO INVESTIGATIONS AND ITS OWNERS, MEMBERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES OR ANY ENGAGEMENT BETWEEN A CLIENT AND A MEMBER AGENCY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
13. Indemnification
You agree to indemnify, defend, and hold harmless El Paso Investigations and its owners, members, and agents from and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your content, your services (if you are a Member Agency), or your violation of these Terms or applicable law.
14. Term and termination
These Terms apply while you use the Services. We may suspend or terminate your access at any time, including for violation of these Terms or non-payment. You may stop using the Services at any time and may cancel membership as described above. Provisions that by their nature should survive termination will survive.
15. Governing law and dispute resolution
Governing law. These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules.
Informal resolution. Before filing a claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.
Binding arbitration; class-action waiver. Except for small-claims matters and claims for injunctive relief regarding intellectual property, any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, seated in Texas. You and El Paso Investigations waive any right to a jury trial and to participate in a class or representative action. If this waiver is unenforceable as to a claim, that claim will proceed in the state or federal courts located in Texas, where you consent to jurisdiction and venue.
16. Changes to the Services and Terms
We may modify or discontinue the Services, and we may update these Terms, at any time. Changes to these Terms are effective when posted, and your continued use of the Services constitutes acceptance of the revised Terms.
17. Force majeure
We are not liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, outages, labor disputes, or governmental actions.
18. General
These Terms and the Privacy Policy are the entire agreement between you and El Paso Investigations regarding the Services. If any provision is held unenforceable, the remaining provisions remain in effect. We may assign these Terms; you may not assign them without our consent. Our failure to enforce a provision is not a waiver. You consent to receive communications and agreements electronically. Headings are for convenience only.
